ARM Duties
To achieve the basic functions incumbent, the Agency shall exercise the following powers:
1 ) prepare and submit to the Government for approval of the Registration Book of goods and materials from state reserves and the Registration Book of material goods from mobilization reserves , sets maximum and intangible levels of stocks prior to be coordinated with ministries and other central administrative authorities ;
2 ) ensure the fulfilment of tasks of the accumulation, refreshment and replacement of material goods of state material reserves stored in institutions , enterprises and organizations created for this purpose and subordinated to the Agency and/or stored in organizations subordinated to other specialized central public administration authorities, local government authorities and other economic entities warehouses on a base-contract;
3 ) organize the preservation and maintenance of state material reserves at the institutions , enterprises and organizations created for this purpose and subordinated to the Agency as well as at the companies and organizations subordinated to other central bodies of public administration and local authorities and also on the spaces of economic agents rendered on contract basis , regardless of their type of ownership;
4 ) conclude additional contracts and agreements for the purchase and delivery of material goods in the state material reserves ;
5 ) release, as established , material assets from state material reserves ;
6 ) determine and apply open prices to material goods delivered ( stored ) and released from the state material reserves as established;
7 ) ensure reimbursement (payment ) of debts by recipients of goods, issued from the state material reserves ;
8) develop jointly with competent bodies, and approve regulations, instructions , provisions regarding the manner and delivery conditions (storage) , preservation and release of material goods from the state material reserves ;
9) exercise control over the execution of normative acts regulating the activities of the Agency and apply measures for the prevention and liquidation of any violation thereof;
10) perform the methodological coordination of statistical records and accounting organization unique material property of the state material reserves and on their movement ; provide , as required, submission of statistical reports and accounting institutions , enterprises and organizations subordinated to the Agency, enterprises and organizations subordinated to other central bodies of public administration and local authorities and the storages in charge ;
11) present to the Ministry of Finance financial reports in the manner set and meeting the deadlines ;
12) submit to the Government , as required, information on the performance of the storage , availability and circulation of material goods from state reserves and mobilization reserves;
13 ) determine the priorities and work programs of scientific research , experimental design and operation in the long-term preservation of goods, ensure their implementation ;
14 ) determine the territorial location , monitor the execution of the construction, reconstruction, repairs and current and re- endowment of institutions , enterprises and subordinated organizations, designed to preserve the material goods of the state material reserve system at the expense of the state budget , the special funds and other funding sources;
15 ) organize Surveillance of state material reserves stored at the subordinated institutions , organizations and enterprises;
16 ) provide on a base-contract , receipt , storage and preservation of the goods subject to the Regulations on the accounting, evaluation and sale of confiscated goods, without a master , seized perishable or limited shelf life , the corpus delicti , the property passed into the possession of the state with the right to inheritance and treasure , approved through Government Decision nr.972 of 11 September 2001 , for which there are possibilities and conditions for storage and preservation
ARM Rights
The Agency shall have the following rights:
1 ) to monitor the execution of measures meant to ensure the creation of the state material reserves and preparation of the system of the state material reserves in exceptional circumstances caused by force- majeure;
2 ) control over the fulfilment of the tasks regarding the creation of mobilization reserves, compliance with preservation conditions, inventory by the institutions , enterprises and organizations subordinated to the Agency , other central bodies of public administration and local government authorities;
3 ) to check for the procedure to be followed and the way on how to develop, use, copy , store , transmit and record the special documentation during the execution of the works in the state material reserves ;
4 ) submit, as required, proposals for updating and completing the existing legislation and regulations of public authorities aimed at issues of state material reserves ;
5 ) submit to public authorities , institutions , enterprises and organizations subordinated to the Agency, enterprises and organizations subordinated to other specialized central executive proposals on the liquidation deficiencies in the creation , preservation and recording of state material reserves and to seek information about their execution ;
6 ) to submit proposals for the establishment of institutions, organizations and enterprises subordinated to approve their statutes to reorganize or liquidate them , as provided by law;
7 ) manage state property entrusted to exercise effective control over its use , coordinate renting conclusion of the institutions , enterprises and organizations subordinate ;
8) to manage state shares in companies and enterprises entrusted by the Government, and to ensure efficient use monitoring ;
9) to enter into contracts with companies providing services subordinate the retention of state material reserves ;
10 ) to conduct commercial activities for the sale of domestic and import- export and refreshing accumulation of material goods, as well as their release from state material reserves in relation to their exclusion from the list approved , with diminishing inventory levels or due to regular updating of assortment structure made by institutions , enterprises and organizations subordinated and other depositories responsible;
11) to accumulate in the existence of available funds , stocks of material goods nomenclature approved contingency with their subsequent inclusion in the nomenclature ;
12) to monitor the activities of institutions, enterprises and organizations subordinated to the perception of a mark-up for material released from the state material reserves , within the limits set by the legislation in force;
13 ) to capitalize, with the consent of the Government, some low-priced material goods in circumstances where their release as a refresh , refresh with time lag , unlock, can not be performed due to market situation ;
14 ) to order disclosure of the situation and the degree of filling of the state material reserves ;
15 ) develop , in cases established by legislation, laws regarding issues of state material reserves , mandatory for ministries , institutions, organizations , businesses whom they are addressed ;
16 ) apply , in the established financial penalties enterprises, organizations , depositories responsible for violating the Law No. 589 -XIII of 22 September 1995 on the state material reserves and mobilization , rules, regulations and guidelines governing the performance of work in the reserves state materials ;
17 ) to submit legal materials courts , law enforcement and other competent bodies for the punishment of persons guilty of violating the provisions of the normative and low-quality execution of works;
18 ) has , through its authorized officials , access to businesses , organizations and institutions subordinated to the right to request and receive the information necessary to exercise their statutory functions ;
19) to establish relationships and collaborate with similar bodies in other countries.
